Personal Injury Overview

The Law Office of Milton W. Brown assists clients throughout New Jersey in a range of matters, including personal injury, workers' compensation, wrongful death, and nursing home abuse and neglect cases.  From our office in Gloucester County, we assist clients in Cumberland, Salem, and Atlantic counties who have been injured or lost a loved one in a car accident, workplace accident, or other incident caused by the negligence or wrongful act of another.

Our areas of practice include:

Automobile Accidents

Auto accidents are among the most common types of personal injury accidents.  In 2009 alone, an estimated 25,576 people died in car crashes in the United States.  Auto accidents can range from minor collisions to catastrophic crashes, and are often caused by driver negligence, such as speeding, cell phone use, drunk driving, or failing to obey traffic signs.  Other common causes of auto accidents include defective auto parts, hazardous weather conditions, unsafe road designs, or poor highway maintenance.

If you have been injured due to a car crash, you may be entitled to recover for the damages you have suffered, including medical bills, lost wages, emotional distress, pain and suffering, and other related costs.  We have assisted victims suffering from complex and serious injuries, including spinal cord and traumatic brain injuries, and have represented those who have lost a loved one in an auto accident in wrongful death actions.

Workers' Compensation Claims

Workers' compensation laws ensure that employers provide financial assistance and medical benefits to employees who have been injured on-the-job due to an accident or who suffer from a work-related illness.  To make a claim for compensation, an employee does not have to prove that the employer was negligent or at fault in causing the injury, but only that the injury was work-related.  Disputes in workers compensation cases often arise over whether the injury actually occurred while the employee was "on-the-job" and how much he or she is entitled to receive in benefits.

  • Third Party Issues

In many workers' compensation claims, an accident may have been the fault or partially the fault of a third party.  Injured workers often sue third parties when workers' compensation benefits or insurance policies do not cover all of the damages they have suffered.  Employers may also have the right to seek reimbursement from the third party to cover the costs of their employee's injuries, or may join the lawsuit as another plaintiff.

Wrongful Death

Wrongful death claims generally arise when a victim suffers fatal injuries in an accident, such as a car, truck, or workplace accident, or an accident caused by a defective product.  Our attorneys understand that losing a loved one is an exceptionally difficult event, and are dedicated to providing compassionate support to help guide you through the process of recovering for the financial and emotional losses you have suffered.

Catastrophic Injuries

Catastrophic injuries such as traumatic brain injuries, or paraplegia or quadriplegia due to a spinal cord injury, often result in permanent disabilities and a lifetime of added medical expenses, not to mention the emotional costs of the challenging circumstances of simply living day to day.  Victims of these injuries and their families deserve to be fully compensated for the damages they have suffered and the comprehensive costs of treatment, rehabilitation, and, in many instances, lifelong care.  Our attorneys have significant experience in representing victims of catastrophic injuries, and are readily familiar with the complex medical issues involved in these cases.

Nursing Home Abuse & Neglect

Nursing home patients are extremely vulnerable to abuse or neglect by the very caregivers who have been entrusted to care for and protect them.  Patients are often unable to report abuse or neglect due to limited ability to communicate, or may be reluctant to report abuse out of fear of retaliation.  If you or a loved one has been the victim of physical, emotional, sexual, or financial abuse or neglect in a convalescent home, nursing home, or other care facility, contact us for immediate assistance.

Slip & Fall/Premises Liability

Property owners owe a duty to maintain their premises in good condition for the safety of others who may enter upon the property.  This duty includes a duty to inspect the premises with reasonable frequency and to make any repairs or otherwise correct unsafe conditions which exist.  If the unsafe condition is not remedied, property owners owe a duty to warn of the unsafe condition, unless it is patently obvious.  Examples of dangerous conditions include loose handrails, torn or uneven carpet, food or spills left on floors, icy sidewalks, and inadequate security or lighting.  If you have been injured due to a slip and fall or while on someone elses property, contact the Law Office of Milton W. Brown or call (866) 942-4909 for caring, tough, and effective representation from experienced personal injury lawyers.

Dog Bites/Animal Attacks

Animal attacks and dog bites are often among the most psychologically damaging and disfiguring injuries suffered.  Puncture wounds are subject to infection, and permanent scarring or nerve damage may result, requiring corrective plastic surgery or ongoing medical treatment.  Victims may also suffer from post-traumatic stress disorder, suffering flashbacks, panic attacks, or having difficulty sleeping.  We aggressively represent victims of dog bites and maulings to obtain the recovery they need and deserve to put this traumatic event in the past.

Trucking and Bus Accidents

Often resulting in catastrophic injuries and wrongful deaths, trucking and bus accident cases are particularly complex.  Many factors may cause or contribute to a truck or bus accident, including driver fatigue, drug use, speeding, improper training, poor maintenance, or defective parts.  In addition to being emotionally-traumatic events, these cases typically involve a tangle of federal and state motor vehicle regulations and personal injury and wrongful death laws.  Our attorneys are sensitive to the many issues involved in trucking and bus accidents and are dedicated to helping you obtain a full legal and emotional recovery.

Motorcycle Accidents

Due to their unprotected nature, motorcycle accidents tend to be particularly serious, often resulting in catastrophic injuries or even death.  Many motorists and law enforcement agents tend to blame motorcyclists as the cause of the accident, but motorists often fail to see motorcycles, causing the biker to take evasive action to avoid a crash.  Dangerous road defects, road repair or construction, or failure of a critical part on a motorcycle can cause or contribute to the cause of a motorcycle accident.   People injured in motorcycle accidents in New Jersey can trust the Law Office of Milton W. Brown to provide them with knowledgeable and effective representation in their personal injury lawsuit.

Products Liability

Under the law, manufacturers must ensure that their products are not dangerous or defective when used in a reasonable manner.  Product manufacturers are held to a standard of strict liability; a plaintiff does not have to prove negligence if they are injured by a defective product.  If a product is inherently dangerous, the manufacturer must ensure that obvious warnings are attached.  If you have suffered an injury or lost a loved one due a defective product, you may be eligible to recover damages.

Medical Malpractice

Doctors and other healthcare professionals are expected to perform with the degree of skill and learning of the average professional in the field.  When a doctor or hospital performs below this standard, causing harm, the injured patient may sue to recover damages in a medical malpractice claim.  Medical malpractice claims commonly arise due to a failure to diagnose or misdiagnosis; failure to obtain informed consent before treating; and surgical mistakes, including performing the wrong surgery or performing surgery on the wrong part of the body, or leaving foreign objects in the body after surgery, such as sponges or medical instruments.
